CULT OF SIR – TERMS AND CONDITIONS

1. ACCEPTANCE OF TERMS

1.1 These Terms and Conditions (“Terms”) govern your (“User” or “you”) access to and use of any and all services, content, communications, and platforms associated with the “Cult of Sir,” which includes, but is not limited to, its Discord server (“Server”), The Vault, The Backend, and any affiliated websites or channels (collectively, the “Services”).

1.2 By accessing, using, or interacting with the Services, you unconditionally and irrevocably agree that you have read, understood, and will be bound by these Terms without modification. These Terms constitute a legally binding agreement between you and Sir Dominic Scott (the “Provider”), including any associated entities, affiliates, predecessors, successors, or assigns.

1.3 If you do not agree to these Terms, you are strictly prohibited from accessing or using the Services. The Provider reserves the right to enforce these Terms to the fullest extent permitted by law, including seeking injunctive relief, damages, attorneys’ fees, and any other remedies deemed appropriate.

2. DISCLAIMER OF WARRANTIES, NO GUARANTEE OF RESULTS & LIMITATION OF LIABILITY

2.1 AS-IS / AS-AVAILABLE PROVISION
‍
   (a) The Services—including but not limited to any hypnotic, “popper,” suggestive, or therapeutic content—are provided on an “AS IS” and “AS AVAILABLE” basis.
   (b) To the fullest extent permissible by law, the Provider expressly disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or title.
   (c) The Provider does not guarantee that the Services will be uninterrupted, timely, secure, or error-free, or that any errors will be corrected.

2.2 NO GUARANTEE OF RESULTS & MEDICAL DISCLAIMER

   (a) The Provider makes no guarantee, representation, or warranty regarding any outcomes or results—psychological, financial, health-related, or otherwise—deriving from the use of hypnosis, “popper” content, or any other content provided through the Services.

   (b) The Services, including any hypnotic or suggestive content, are not intended to diagnose, treat, cure, or prevent any medical or psychological condition. They are for informational and/or entertainment purposes only. You should consult a qualified healthcare professional before relying on any such content.
   (c) Any reliance upon or usage of the Services (including Hypnosis Materials) is undertaken solely at your own risk and discretion.2.3 LIMITATION OF LIABILITY
   (a) To the maximum extent permitted by applicable law, the Provider, including but not limited to the Cult of Sir, The Vault, The Backend, Sir Dominic Scott, affiliates, agents, licensors, employees, officers, directors, contractors, and successors, shall bear no liability for any direct, indirect, incidental, consequential, punitive, or exemplary damages arising out of or relating to your access to or use of the Services.
   (b) This includes, without limitation, any claims for personal injury, psychological harm, financial loss, loss of data, loss of goodwill, or any other type of damage, whether based on negligence, contract, tort, strict liability, or any other legal or equitable principle.
   (c) You expressly waive and relinquish any and all claims against the Provider, even in the event of alleged negligence or other fault on the part of the Provider.2.4 CROSS-JURISDICTIONAL APPLICABILITY
   (a) You acknowledge that laws and regulations relating to hypnosis, “popper” content, psychological or mind-altering material, and similar activities vary among jurisdictions. It is your responsibility to ensure that your use of the Services complies with the laws of your jurisdiction.
   (b) The Provider expressly disclaims any obligation to ensure that the Services comply with local regulations in any particular jurisdiction, and assumes no liability for your use of the Services where it may be restricted or prohibited by law.

3. SALES, REFUNDS & CHARGEBACK POLICY

3.1 FINALITY OF SALES
   (a) All sales or financial transactions made to Sir Dominic Scott or any entity associated with the Cult of Sir are deemed final, complete, and irrevocable upon receipt of payment.
   (b) By purchasing access, products, or services from the Provider, you agree that you have no right to request or demand a refund beyond what is stated in these Terms or as required by applicable consumer protection laws.

3.2 REFUND CRITERIA

   (a) Refunds, if any, are granted solely at the Provider’s absolute discretion and only under demonstrable circumstances involving material misrepresentation or functional defects in the purchased products or services.
   (b) Subjective dissatisfaction, buyer’s remorse, or failure to achieve personal expectations shall not constitute grounds for a refund unless explicitly required under relevant consumer protection statutes.
   (c) Any determination by the Provider to issue a refund for a particular case does not create an obligation to offer refunds in the future.

3.3 CHARGEBACKS & UNAUTHORIZED REVERSALS

   (a) You agree not to initiate chargebacks, reversals, or similar processes without first making a good-faith effort to resolve your concerns with the Provider.
   (b) Initiating an unauthorized chargeback or reversal constitutes a material breach of these Terms and may result in immediate suspension or termination of your access to the Services, as well as legal action to recover damages, including any associated fees and attorneys’ fees.
   (c) The Provider may contact payment processors, financial institutions, or relevant authorities if such actions are deemed fraudulent or in bad faith.

4. ACCESS, COMMUNICATION & DISCORD SERVER ETIQUETTE

4.1 NO RIGHT TO DIRECT COMMUNICATION
‍
   (a) Access to the Cult of Sir or any related Services does not confer an automatic right to communicate directly with Sir Dominic Scott or any of the Provider’s representatives.
   (b) Any communication, if granted, is at the Provider’s sole discretion and may be limited, suspended, or terminated without notice or explanation.

4.2 USER CONDUCT & DISCORD SERVER GUIDELINES
‍
   (a) Users accessing the Discord Server or other interactive forums must comply with all posted rules, guidelines, and norms, as well as Discord’s Terms of Service.
   (b) Activities deemed harassing, infringing, fraudulent, or otherwise unlawful may result in immediate termination of access and potential legal action.
   (c) The Provider reserves the right to remove any content or user from the Server that violates these Terms or any other rules, without prior notice.

4.3 COURTESY DISCOUNTS & ABUSE

   (a) From time to time, the Provider may offer courtesy discounts or promotional pricing. Such discounts are extended as a privilege, not a right, and may be withdrawn at any time without notice.
   (b) Abuse of courtesy discounts—including, but not limited to, using multiple accounts, sharing discount codes beyond authorized channels, or making fraudulent claims—constitutes a material breach of these Terms and may result in immediate suspension or termination of access and legal action.

5. AGE REQUIREMENT & LEGAL COMPLIANCE

5.1 LEGAL AGE OF MAJORITY
‍
   (a) By accessing or using the Services, you represent and warrant that you have reached the age of majority in your jurisdiction and possess the legal capacity to enter into these Terms.
   (b) Misrepresentation of age or legal capacity is a material breach of these Terms, subjecting you to immediate suspension of access and potential legal consequences.5.2 COMPLIANCE WITH LAWS
   (a) You assume full responsibility for determining and adhering to all legal requirements applicable to your use of the Services, including local regulations related to hypnosis, psychological materials, digital media, and/or content deemed adult or mind-altering in nature.
   (b) The Provider disclaims any obligation to verify your compliance and assumes no liability for consequences arising from your non-compliance with any laws or regulations.

6. INTELLECTUAL PROPERTY & CONTENT USAGE RESTRICTIONS

6.1 OWNERSHIP OF CONTENT
‍
   (a) All content provided through the Cult of Sir—including text, images, videos, audio (including Hypnosis Materials), scripts, software, and interactive features—is the exclusive property of the Provider or its licensors, protected under applicable intellectual property laws and treaties.
   (b) No right, title, or interest is transferred to you beyond the limited license explicitly granted herein.

6.2 LICENSE GRANT & RESTRICTIONS

   (a) The Provider grants you a limited, revocable, non-exclusive, non-transferable license to download, view, and use the content solely for your personal, non-commercial use.
   (b) You shall not reproduce, copy, distribute, publicly display, modify, or create derivative works of the content without the Provider’s prior written consent.
   (c) Unauthorized sharing, distribution, or resale of the Provider’s content, including Hypnosis Materials, may result in immediate termination of your access and legal action for damages, injunctive relief, and recovery of attorneys’ fees.

6.3 REMEDIES FOR UNAUTHORIZED USE

   (a) In the event of any unauthorized use of the Provider’s intellectual property or violation of these Terms, the Provider reserves the right to seek all remedies available under law or in equity.
   (b) You agree to indemnify and hold harmless the Provider for any damages or losses resulting from your unauthorized use, infringement, or misappropriation of the Provider’s intellectual property.

7. MODIFICATIONS TO TERMS

7.1 RIGHT TO MODIFY
‍
   (a) The Provider reserves the unilateral right to modify, amend, or replace these Terms at any time, effective immediately upon posting within the Services or upon User notification, whichever occurs first.
   (b) It is your responsibility to periodically review the Terms for any updates.7.2 CONTINUED USE AS ACCEPTANCE
   (a) Continued use of any portion of the Services following modifications to these Terms constitutes your binding acceptance of the updated Terms.
   (b) The Provider assumes no liability for any User’s failure to review or comprehend updated Terms.

8. DISPUTE RESOLUTION, GOVERNING LAW & ARBITRATION

8.1 GOVERNING LAW
‍
   (a) These Terms, and any disputes or claims arising out of or relating to these Terms or the Services, shall be governed exclusively by the laws of the jurisdiction specified by the Provider, without regard to conflict-of-law principles.
   (b) The Provider reserves the right to determine the applicable forum and jurisdiction where any dispute will be adjudicated.

8.2 ARBITRATION & CLASS ACTION WAIVER

   (a) Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved exclusively through **binding arbitration**, administered by the American Arbitration Association (“AAA”) or a similar arbitral body chosen by the Provider, in accordance with the rules of such organization.
   (b) The seat or venue for arbitration shall be determined by the Provider, and you agree to submit to personal jurisdiction and venue in such forum.
   (c) You expressly waive the right to initiate or participate in class action suits, class-wide arbitrations, private attorney-general actions, or any other proceeding in which someone acts in a representative capacity.

8.3 WAIVER OF RIGHTS IN COURT

   (a) You irrevocably waive any right to a trial by jury to the fullest extent permitted by law.
   (b) If any portion of this arbitration agreement is found unenforceable, the remainder shall continue in full force and effect, and you agree to submit to the exclusive jurisdiction of courts located in the Provider’s chosen forum for resolution of any claims.

9. TERMINATION, SUSPENSION & REMEDIES

9.1 TERMINATION & SUSPENSION

   (a) The Provider may terminate or suspend your access to all or any part of the Services at any time, with or without notice, for any reason, including breach of these Terms or suspected fraud or misconduct.
   (b) Upon termination or suspension, all rights and licenses granted to you under these Terms immediately cease.

9.2 RESERVATION OF RIGHTS

   (a) The Provider reserves the right to pursue all legal and equitable remedies available in order to enforce these Terms and protect its rights.
   (b) Such remedies may include injunctive relief, specific performance, the recovery of damages, attorneys’ fees, and any other relief permitted by law or equity.

10. SEVERABILITY

10.1 If any provision of these Terms is found by a court or tribunal of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be reformed to the minimum extent necessary to make it valid and enforceable, without affecting the remaining provisions, which shall remain in full force and effect.

11. ACKNOWLEDGMENT & ENFORCEMENT

11.1 By accessing or using the Services, you represent that you have read, understood, and agree to abide by these Terms. Your compliance with these Terms is a condition of your continued right to access the Services.

11.2 Failure to comply with these Terms may result in immediate suspension or termination of access, forfeiture of any fees or payments made, and potential legal action by the Provider to enforce compliance or recover damages.

11.3 The Provider reserves the right to enforce these Terms to the fullest extent permissible by law, including seeking equitable remedies where appropriate.

11.4 SURVIVAL

   (a) Any provision of these Terms that, by its nature, is intended to survive the termination or expiration of these Terms (including but not limited to disclaimers, limitation of liability, indemnities, and dispute resolution clauses) shall so survive.

12. ENTIRE AGREEMENT

12.1 These Terms, together with any additional written policies, disclaimers, or agreements provided by the Provider (including any posted Privacy Policy), constitute the entire agreement between you and the Provider regarding the subject matter herein, superseding all prior or contemporaneous agreements, representations, or communications.12.2 No oral representation or statement by any party shall be binding unless expressly incorporated herein.
